Any Fan Submission that you submit or otherwise transmit to High Moon Studios, Inc. ("High Moon") via this website, email, facsimile, mail or otherwise will be treated as non-confidential materials and shall be deemed, and shall remain, the property of High Moon. By submitting or transmitting your Fan Submission, you hereby grant High Moon all right, title and interest in the Fan Submission and High Moon shall exclusively own all now known or hereafter existing rights in and to the Fan Submission of every kind and nature, in perpetuity, throughout the universe and shall be entitled to unrestricted use (including without limitation the sale and/or exploitation) of the Fan Submission for any purpose whatsoever, commercial or otherwise, without compensation, credit or any other rights to you as the provider of the Fan Submission. By submitting or transmitting your Fan Submission you irrevocably acknowledge and agree to the foregoing grant of rights and interests. If applicable law restricts or limits the foregoing provisions of this paragraph, you agree, without limitation of the foregoing that in no event shall High Moon's liability with respect to the Fan Submission exceed the sum of Two Hundred Fifty Dollars ($250.00). Any controversy or claim arising out of our receipt of Fan Submission will be settled by arbitration in San Diego, California before a single arbitrator appointed by the American Arbitration Association. The prevailing party in any such arbitration has the right to recover its reasonable attorneys' fees and costs from the other party.
